ALLTOWN NEIGHBORHOOD PERKS DORITOS® MOST VALUABLE FLAVOR PROMOTION

PROMOTION TERMS

1. WHO IS ELIGIBLE: This Alltown Neighborhood Perks® Doritos® Most Valuable Flavor Promotion (“Promotion”) is open to individual legal residents of Connecticut, Massachusetts, Maine, New Hampshire, New York, Rhode Island, and Vermont (collectively, the “Promotion States”) who are age eighteen or older at time of entry. Employees, officers, and directors (and their immediate family or household members, whether or not related) of Global Montello Group Corp. (“Sponsor”) and its parent, affiliates and subsidiaries, and each of their respective advertising, marketing, promotional, judging and fulfillment agencies, are not eligible to enter or win.
2. WHEN TO ENTER: The Promotion begins at 12:00:01 AM Eastern Time (“EDT”) on January 5, 2025, and ends at 11:59:50 PM EDT on January 19, 2025 (“Entry Period”). Sponsor is the official timekeeper of the Promotion.
3. HOW TO ENTER: During the Promotion Period, go to https://myneighborhoodperks.com/doritos and fill out a Doritos® Most Valuable Flavor registration form and bracket. Follow the links and instructions to complete and submit the registration form and bracket. You must provide the emailassociated with your Alltown Neighborhood Perks® account (“Account”). By completing and submitting the registration form and bracket (“Entry”), you automatically will receive one digital account credit for the Promotion.

In order to participate in the Promotion, you must have an Alltown Neighborhood Perks® Account (“Account”).  If you do not have an Account, you may create one at https://myneighborhoodperks.com or download the Alltown Neighborhood Perks® app from your mobile app store. Creating an Account is free. Please visit https://myneighborhoodperks.com/#how-it-works for details and certain . terms and conditions regarding your Account.

4. ENTRY LIMIT: Limit: One (1) Promotion Entry and Promotion Product per person during the Promotion Period. Multiple entrants are not permitted to share the same loyalty card, Account, enrolled phone number, or email address.  Any attempt by any entrant to obtain more than one (1) Entry by using multiple/different email addresses, identities, registrations or logins, or any other methods will void that entrant’s Entries and that entrant may be disqualified from the Promotion. Any use of robotic, repetitive, automatic, programmed, or similar entry methods or agents (including, but not limited to, sweepstakes entry services) will void all Entries by that entrant.

Participation constitutes your full and unconditional agreement to these Offer Terms and Sponsor’s decisions, which are final and binding (without right of appeal) in all matters related to the Promotion. Receiving a digital Account credit  is contingent upon fulfilling all requirements set forth herein.

In the event of a dispute as to any electronic Entry, the authorized account holder of the email address used to enter will be deemed to be the entrant.  The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

5. PROMOTION PRODUCT:

All entrants will receive the following Promotion Product: a digital account credit to your Account valid for one (1) 2.75 ounce bag of the winning Doritos® flavor, based on votes (“Promotion Product”) while supplies last. Approximate retail value (“ARV”) of each Promotion Product: $2.75. Promotion Product Details: All Promotion Product details are determined by Sponsor in its sole discretion. No transfer, cash or other substitution of a Promotion Product is permitted except that Sponsor reserves the right to substitute a Promotion Product with a product of equal or greater value but no other substitution or transfer of a Promotion Product is permitted.  Promotion Product only available while supplies last. The digital account credit has no cash value.  Sponsor is responsible only for delivery of the digital account credit and is not responsible for the Promotion Product’s utility to the participant. Each participant is solely responsible for all taxes, fees and other expenses associated with acceptance and use of the Promotion Product.  EACH PROMOTION PRODUCT IS AWARDED “AS IS” WITHOUT ANY WARRANTY OR GUARANTEE FROM SPONSOR. Sponsor reserves the right to choose a winning flavor of the Promotion Product based on availability.

7. PROMOTION PRODUCT DELIVERY: Promotion Product is awarded as an Account credita available through your Account redeemable for one 2.75 ounce bag of winning Doritos® flavor at an Alltown Neighborhood Perks location at time of redemption. An Entry may be disqualified if the Account creditor related communication is undeliverable, as determined by Sponsor in its sole discretion, whether due to the entrant’s failure to have an Alltown Perks Account or otherwise. Sponsor and its parent, affiliates and subsidiaries, and their respective representatives, employees and agents, are not responsible for Promotion Product delivery failure due to delivery service cancellations, delays, or interruptions due to acts of God, acts of war, natural disasters, weather, acts of terrorism, fraud, virus, bug, unauthorized human intervention, civil unrest or other causes beyond the control of Sponsor, including any action or failure to act on the part of an entrant.
8. ENTRANT RELEASE: BY PARTICIPATING IN THIS PROMOTION:

• YOU WARRANT TO SPONSOR THAT YOU MEET THE ELIGIBILITY REQUIREMENTS OF THE PROMOTION, PROVIDE YOUR FULL AND UNCONDITIONAL AGREEMENT TO THESE OFFER TERMS AND THE DECISIONS OF SPONSOR, WHICH ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.
• YOU AGREE THAT ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFER TERMS, PARTICIPANT RIGHTS AND OBLIGATIONS, OR THE RIGHTS AND OBLIGATIONS OF THE SPONSOR IN CONNECTION WITH THIS PROMOTION, SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE COMMONWEALTH OF MASSACHUSETTS, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES.
• YOU CONSENT TO THE JURISDICTION AND VENUE OF THE FEDERAL, STATE AND LOCAL COURTS LOCATED IN SUFFOLK COUNTY, MASSACHUSETTS.
• YOU AGREE (EXCEPT WHERE PROHIBITED) THAT: (i) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROMOTION OR A PROMOTION PRODUCT WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (ii) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES BUT IN NO EVENT ATTORNEYS' FEES; AND (iii) UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN, AND YOU HEREBY WAIVE ALL RIGHTS TO, (A) INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND (B) HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.
• YOU RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENT, AFFILIATES AND SUBSIDIARIES, AND THEIR RESPECTIVE AGENTS AND ADVERTISING AND PROMOTIONAL AGENCIES AND THE DIRECTORS, OFFICERS, MANAGERS, MEMBERS, UNITHOLDERS, EMPLOYEES, SUCCESSORS AND/OR ASSIGNS OF EACH (COLLECTIVELY, THE “PROMOTION PARTIES”) FROM ANY DAMAGE, PHYSICAL HARM, LOSS OF LIFE,  INJURY, LOSS OR LIABILITY, DUE IN WHOLE OR PART, DIRECTLY OR INDIRECTLY, ARISING FROM OR RELATED TO PARTICIPATION IN THIS PROMOTION OR THE ACCEPTANCE, USE OR MISUSE OF A PROMOTION PRODUCT. BY PARTICIPATING, YOU ALSO GIVE A COMPLETE RELEASE TO INSTAGRAM FOR LIABILITY ARISING FROM THIS PROMOTIONAL PRODUCT.
• BY ACCEPTING A PROMOTION PRODUCT, YOU AGREE TO USE OF YOUR NAME, ADDRESS, LIKENESS AND/OR PROMOTION PRODUCT INFORMATION FOR PROMOTIONAL PURPOSES RELATED TO THE PROMOTION IN ANY MEDIUM WITHOUT ADDITIONAL COMPENSATION TO THE EXTENT PERMITTED BY LAW.

9. GENERAL CONDITIONS: THIS PROMOTION IS VOID OUTSIDE OF THE PROMOTION STATES AND WHERE PROHIBITED, TAXED OR OTHERWISE RESTRICTED BY LAW. All applicable federal, state and local laws, rules and regulations apply. The Promotion Parties are not responsible for late, lost, incomplete, undeliverable, misaddressed or misdirected entries, mail, email or other communications; errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information or Accounts, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices and their settings or transmission lines; data corruption, theft or destruction; or unauthorized access to or alteration or loss of Promotion-related information, Accounts or materials. Sponsor reserves the right to restrict participation from any IP or MAC address, device or Account if suspicious activity is detected or suspected. Sponsor assumes no responsibility for undeliverable emails resulting from any form of active or passive email filtering by a participant's Internet service provider or for insufficient space in a participant 's email account to receive email.  The Promotion Parties disclaim any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Promotion, including Account use and creation.  Sponsor reserves the right, at its sole discretion, to modify, terminate or suspend this Promotion if for any reason this Promotion cannot be conducted as designed or intended. If Sponsor modifies, terminates or suspends this Promotion, Sponsor will post a notice at www.myneighborhoodperks.com and, if time and circumstances allow, determine procedures for awarding the Promotion Product.  Sponsor reserves the right, at its sole discretion, to disqualify any participant from this Promotion or any other promotion or loyalty program conducted by Sponsor or any of its affiliates or subsidiaries if the participant’s fraud or misconduct disrupts the intended execution of this Promotion.  Sponsor also reserves the right to correct errors or inconsistencies in promotional materials or in the announcement of a Promotion Product. If Promotion -related promotional materials and these Offer Terms are inconsistent, then the Offer Terms shall govern with respect to this Promotion. Sponsor and its parent, affiliates and subsidiaries undertake no liability and no responsibility, and make no warranties, express or implied, with respect to any failure to perform or negligent performance of any of their service providers assisting with execution of this Promotion.

CAUTION: Any attempt by any individual to deliberately undermine the legitimate operation of this PROMOTION is a violation of criminal and civil laws.  Sponsor reserves the right to seek damages to the fullest extent permitted by law.
